Forms Requirements and Guidelines
Crown Copyright
Capsoft UK Ltd. is able to reproduce Crown copyright material under the terms and
conditions of our Core Licence.
This licence includes the non-exclusive right to:
- Publishing the forms in any medium. This includes featuring the forms on our website
which can be accessed via the world-wide web;
- Authorising users and subscribers, who use our electronic or digital products to access
the material by means of an End-User licence;
- It does not otherwise allow Capsoft UK Ltd. to authorise the reproduction of forms.
Capsoft UK Ltd. is obliged to feature the following copyright statement when publishing the
forms:
Crown copyright material is reproduced with the permission of the Controller of HMSO and
the Queens' Printer for Scotland.
Court Service
There is a waiver of copyright for Court Service forms. Waiver means that although copyright
is asserted, Government wishes to encourage the widespread use of the material. Users are
permitted to copy or publish the material in any medium without having to seek formal permission
or to pay a fee and are asked to ensure that:
- the material is reproduced accurately and not in a misleading context;
- that the material is correctly acknowledged and that the source and status of the
material is identified.
Companies House
Capsoft UK Ltd. has permission to reproduce the Companies House forms within this library.
Forms are used in their entirety as published by Capsoft UK Ltd. and must not be altered
in any way.
Forms delivered to Companies House are scanned to produce an electronic image. Section 706 of
the Companies Act 1985 allows Companies House to reject documents that cannot be captured
electronically, giving a notice saying why they are unacceptable. An acceptable copy must be
delivered within 14 days of the notice (otherwise we treat the original as not having been
delivered).
The guidelines below set out the quality of the documents that Companies House require in order
for them to be acceptable.
- On completion please print the form, sign and date it before returning it to us
by post.
- Do not use a dot matrix printer, as this will not provide the required output
quality.
- All statutory forms have to be dated and signed and sent to us by post.
- Documents must be on A4 paper which is white or otherwise of a background
density not greater than 0.3.
- Documents must be on paper with a matt finish.
- Remember - photocopies can result in a grey shade that will not film well.
Land Registry
Capsoft UK Ltd. has the non-exclusive right by way of licence to:
- Reproduce the Forms on a computer-readable database
- To sub-license end-users to use the Forms Database to produce printed copies of the Forms for the end-users' personal use, or for their use on behalf of their clients, only
- to sub-license the Licensee's authorised dealers to grant sub-sub-licenses to end-users to use the Forms Database for the purpose of producing printed copies of the Forms for the end-users' personal use, or for their use on behalf of their clients, only.
As part of our sub-licensing obligations Capsoft UK Ltd. is obliged in the case of a sub-license to an end-user:
- that all printed copies of the Forms produced by the sub-licensee shall comply in all respects with the hard copies approved by Land Registry.
- not to use Out of Date Forms
- to ensure that every printed copy of the Forms carries the following acknowledgement:
"Crown copyright (ref: LR/SC49)"
- not to transmit or re-transmit the Forms electronically except in-house or where the Land Registration Rules or Land Charges rules allow, by facsimile transmission
- not to permit others to use the Forms Database or any part thereof
- not to permit others to use (with the exception of Land Registry) printed copies of the Forms produced from the Forms Database
- not to sell the Forms
- to obtain any approval for the use or acceptance of the Forms required under the Land Charges Act and Land Charges Rules and the Land Registration Acts and Land Registration Rules.
The Crown copyright reference is unique to Capsoft UK Ltd. whose forms the Forms Unit at the Land Registry has approved.
Registers of Scotland Executive Agency
Capsoft UK Ltd has been granted a licence to reproduce Crown copyright material produced by The Registers of Scotland Executive Agency.
As part of our sub-licensing obligations Capsoft UK Ltd. is stipulates the following obligations on the part of the end-users:
- that the Official Forms may be reproduced from the Package by end-users only and shall be for the use of end-users and their clients only;
- not to permit third parties to use Package;
- that out of date Forms must not be used;
- not to transmit the Forms electronically except for in-house use;
- not to sell the Forms;
